These Terms of Use & Sale apply when you visit iamabearsnack.com, create an account, or place an order through this website. By using the site, you agree to these terms and the incorporated Returns & Order Issues and Privacy Policy.
Purchases made through Etsy are also governed by Etsy’s terms, checkout, and the policies presented for the applicable Etsy listing or shop.
eligibility and accounts
You must be legally able to enter into a purchase agreement. If you are not the age of majority where you live, use the store only with the involvement of a parent or legal guardian. You are responsible for information submitted through your account and for keeping account credentials secure.
products and availability
We try to describe and display products accurately, but garment colors, measurements, print placement, and finished appearance may vary slightly from mockups or across production runs. Available products, colors, sizes, prices, and descriptions may change without notice.
orders and acceptance
Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not require us to accept or fulfill an order. We may reject or cancel an order and issue a refund if an item is unavailable, payment cannot be verified, fraud is suspected, shipping is unavailable, or a listing contains a material pricing or description error.
prices, payment, and taxes
Prices are shown in U.S. dollars unless stated otherwise. You authorize the payment provider displayed at checkout to charge the order total, including applicable taxes. Promotions and discount codes may have separate conditions, cannot be redeemed for cash, and may be changed or withdrawn where permitted by law.
made-to-order fulfillment
Products are made after purchase by independent production partners. Estimated production and delivery information appears on Sizing, Shipping & FAQ. Our made-to-order cancellation, return, defect, address, and delivery terms are part of these Terms and appear on Returns & Order Issues.
intellectual property
The Bearsnack name, original artwork, photographs, copy, graphics, and site design are owned by or licensed to Softseas Digital LLC and are protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, sell, modify, or commercially use them without written permission.
acceptable site use
Do not use the site unlawfully; attempt unauthorized access; interfere with security or operation; introduce malicious code; scrape the store in a way that burdens its systems; impersonate another person; or use site content to infringe the rights of Bearsnack or anyone else.
third-party services and links
The store relies on third parties for hosting, ecommerce functions, payments, production, analytics, and delivery. Their services may be governed by separate terms and privacy practices. We are not responsible for independent third-party websites merely because the store links to them.
disclaimers
Except for express commitments made in these Terms or where the law requires otherwise, the site and its content are provided on an “as available” basis. We do not promise that the site will always be uninterrupted, error-free, or free from harmful components. Nothing here excludes warranties or consumer protections that cannot lawfully be excluded.
limitation of liability
To the fullest extent permitted by law, Bearsnack and Softseas Digital LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site or a purchase. To the fullest extent permitted by law, total liability for a claim relating to an order will not exceed the amount paid for the order giving rise to the claim. These limitations do not apply where prohibited by law.

Please contact us first so we can try to resolve an order or site concern directly. Nothing in these Terms prevents either party from using rights or remedies available under applicable law.
governing law and venue
These Terms and any dispute arising from the website or an order are governed by the laws of the State of Maryland and applicable federal law, without regard to conflict-of-law principles. Subject to any non-waivable consumer rights or other applicable requirements, legal proceedings must be brought in a state or federal court located in Maryland, and the parties consent to the jurisdiction of those courts.
changes, severability, and waiver
We may update these Terms by posting a revised version and update date. Changes apply prospectively unless the law permits otherwise. If a provision is found unenforceable, the remaining provisions remain in effect. A delay in enforcing a provision is not a waiver of it.
